Holidays are an essential part our lives. They give us the opportunity to relax, to spend time away from the pressures of work and the stresses and strains of everyday life and allow us to spend some valuable time with our loved ones, whether that is friends or family. We expect our holiday time to be perfect but if something goes wrong, like being involved in a accident and needing to make a holiday accident claim. This can have a huge impact, not just because of your injuries but also because of the disappointment of losing out on your down time.
We know that an accident whilst you are on holiday abroad will have been quite worrying for you. If you did not speak the language, it would have been difficult to communicate with your medical team and you may have struggled to pay the medical bills you incurred being treated for your injury. The chances are, by the time you did get home, you were much more stressed than you were before you went away.
However, depending on the circumstances of your accident, you may be able to make a claim for compensation back here in the UK.
The circumstances of your accident will decide whether you will can claim or not. If you were injured in an accident at your hotel or apartment due to them being unsafe, and you booked your holiday through a travel agency, then you may be able to claim against your tour operator. The same applies if your accident happened whilst you were on a trip organised by your tour operator and booked through your travel representative.
If you had a car accident on holiday or were injured on a coach or mini-bus in a road traffic accident, you will have to make your compensation claim in that country and we can help you with this. You should be aware that the time limits for making a claim in other countries will not be the same as in the UK, so it would be wise to speak to us as soon as possible so we can start our enquiries into your injury claim.
Please also be aware that some countries do not pay out compensation all for injuries caused by accidents and most will not pay as much as in the UK.
In addition to compensation for your holiday injuries, you may be able to claim back some of the money for the loss of enjoyment of your holiday, particularly if your accident happens early on in your break.
You have three years from the date of your accident to make a personal injury claim if you are making it here in England or Wales, but if you are making the claim in another country, I their time limits for personal injury claims will apply and you should contact us immediately so we can give you advice.
There is every possibility a claim abroad will take a significant amount of time and you should prepare yourself for this. We will do all we can to move your claim forwards, but you will appreciate, this is not always possible long distance.
By choosing CCH & Co. to make your holiday accident claim, you can be sure that you have a specialist and experienced team of qualified solicitors advancing your claim onto completion.
