When to make a Workplace Injury Claim

We may seem like invincible superheroes to somebody in our lives, in reality  we are only human and can get hurt in scenarios which we can’t predict, such as in the workplace. Despite the standard of workplace safety is very high in the UK, there are still 621,000 people had a non-fatal injury at work in 2015/16, according to the annual Labour Force Survey provided by the Health and Safety Executive (HSE).These injuries include being hit by a moving object (10%), slipping or tripping (19%) and lifting or carrying (20%). Fortunately, the rate of self-reported non-fatal injuries have been on a downward trend.

What does the law say about workplace injury?

In the UK, there is a Health and Safety at Work Act, along with multiple regulations, all aims to reduce workplace injuries. In essence, every employer has a duty of care to provide:

  • A safe place of work
  • Safe plant and equipment
  • A safe system of work and is followed through
  • Safe fellow employees

Any breach of these common law duties amounts to negligence and would mean that you would be able to make a workplace injury claim.
