The pavement tripping accident claim arose as a result of injuries suffered as a result of a serious tripping accident. The claim for damages was pursued against the London Borough of Westminster. Our client suffered quite a complicated fracture to her ankle. She had surgery carried out and failed to recover from this and subsequently developed symptoms of a Complex Regional Pain Syndrome. In this latter aspect of the claim a number of investigations had to be carried out and ultimately we instructed a Pain Management Consultant to report on her symptoms who confirmed that she was indeed suffering from Complex Regional Pain Syndrome.
Liability was not in issue in this case, this having been accepted by the third party. There were however substantial problems in assessing quantum due to the complicated nature of the injuries suffered by our client. I received an offer from the third party to settle this claim of just a few thousand pounds which was rejected, and after obtaining proper medical evidence we ultimately agreed a settlement of £25,000.
